These Terms of Service (“Terms”) govern your access to and use of websites, applications, and online services operated by Canadian Biotech Limited (“we”, “us”, “our”) for the CheckFor® brand, including this marketing site, product verification tools, store locator experiences, contact and application forms, and related content (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. These Terms are provided for general information and are not legal advice; have qualified counsel review them for your situation, especially for healthcare, regulatory, or cross-border use.
Eligibility and accounts
You may use the public areas of the Services in line with these Terms. Some features (for example distributor dashboards or admin tools) may require an account, invitation, or separate agreement. You are responsible for activity under credentials issued to you and for keeping passwords or access tokens confidential.
Permitted use
You agree to use the Services only for lawful purposes and in a way that does not:
- Violate applicable law or third-party rights;
- Attempt to gain unauthorized access to our systems, data, or other users’ information;
- Interfere with or disrupt the Services (including by introducing malware, excessive automated requests, or scraping that impairs performance);
- Misrepresent your identity or affiliation, or misuse verification codes, QR flows, or analytics in order to deceive or harm others.
We may suspend or restrict access where we reasonably believe these Terms or the security of the Services are at risk.
Medical devices, product information, and regulatory status
CheckFor products are medical devices or related products subject to regulatory requirements. Information on the Services is provided for professional and general informational purposes and does not replace the instructions for use (IFU), product labeling, training, or judgment of qualified healthcare professionals.
- Always read and follow the IFU and local labeling for each product.
- Regulatory clearance, registration, or approval varies by country and region; a product shown on the Services may not be authorized where you practice or sell. You are responsible for confirming local status before purchase, promotion, or use.
- Nothing on the Services constitutes medical advice, diagnosis, or treatment.
Product verification
Authenticity or verification features (for example QR or code checks) are intended to help users confirm information we associate with a code at the time of the request. Results depend on accurate entry, supply-chain data, and system availability. Verification is not a guarantee against all counterfeiting or misuse and should be interpreted together with packaging, IFU, and procurement controls.
You must not use verification tools to probe, overload, reverse engineer, or circumvent our systems, or to generate misleading records.
Store locator and third-party locations
Any store locator or “where to buy” feature lists independent third parties where applicable. We do not control those retailers’ practices, stock, pricing, or advice. Listings are provided as is for convenience; call ahead to confirm availability. Mapping and routing may rely on third-party providers (for example map platforms); their terms apply to your use of those features.
Forms, applications, and communications
When you submit contact forms, distributor applications, or similar information, you represent that the information is accurate to the best of your knowledge. Submitting an application does not guarantee acceptance; we may evaluate partners under separate criteria and agreements.
Intellectual property
The Services, including text, graphics, logos, product names, and layouts, are owned by us or our licensors. CheckFor and related marks are trademarks of Canadian Biotech Limited or its licensors. You may not use our marks or copy substantial portions of the Services for commercial use without our prior written consent, except as allowed by law for fair use or temporary technical copying needed to browse the site.
Third-party services
The Services may link to third-party sites or embed tools (for example maps, analytics, or email). We are not responsible for third-party content or practices. Use of those services may be subject to separate terms and privacy notices.
Disclaimer of warranties
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CANADIAN BIOTECH LIMITED AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US SPECIFICALLY FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), IF NO SUCH FEES APPLIED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.
Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Canadian Biotech Limited and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your violation of third-party rights.
Privacy
Our collection and use of personal information is described in the Privacy Policy, which forms part of these Terms where incorporated by reference.
Changes
We may update these Terms from time to time. We will adjust the “Last updated” date when we do. Continued use of the Services after changes constitutes acceptance of the revised Terms where permitted by law. If we make material changes, we may provide additional notice where appropriate.
Governing law and disputes
These Terms are governed by the laws of the United Republic of Tanzania, without regard to conflict-of-law principles, except where mandatory laws of your jurisdiction (for example consumer protections) require otherwise. Subject to those mandatory rules, you agree that the courts located in Dar es Salaam, Tanzania shall have exclusive jurisdiction over disputes arising from these Terms or the Services, unless we agree otherwise in writing.
If any provision of these Terms is held invalid, the remaining provisions remain in effect.
